Serious reasons not to buy an ATV without a PSM

…the consequences can be dire: you will be left without both the vehicle and your money.

Enticing headlines on the internet and on classified ad sites, such as “Buy an ATV without a PSM” and “ATV without documents, cheap”, have surely come up for everyone who has faced buying a motorcycle or ATV. Sellers promise a price difference of several hundred thousand rubles on such ATVs. On paper it all looks great, but a seller of a “gray market” ATV is unlikely to tell you about the consequences that every buyer of such “unofficial” equipment will inevitably face. And the consequences can be dire: you will be left without both the vehicle and your money.

1. Under Russian law, every vehicle must have documents. For cars and motorcycles this is the PTS; for ATVs and utility vehicles it is the PSM. These documents confirm that the vehicle was imported into the country legally and is permitted to travel on public roads, and that taxes and duties have been paid on it.

When buying a “gray” AODES ATV or another brand, you will be offered only a sales contract and, at most, a sports equipment passport. Even if you think you will buy such a vehicle and ride only in the forest or at a garden plot, you are already deceiving yourself at the stage of having these thoughts. You will have to use public roads more than once if you plan to ride in clubs, go touring, or ride with friends who share your interests, and so on. Getting onto roads is unavoidable.

In that case, the first Gostekhnadzor or traffic police patrol may check your documents. You may have no registration or plates on the ATV, which means a fine, but without a PSM the vehicle is taken to an impound lot. Getting it back will take considerable effort, be sure of that. In Russia there are already cases of owners having to go to court for the right to get their vehicle back, but without a PSM the legality of ownership is always in question, since the buyer holds only a sales contract. That document confirms the fact of the transaction but does not prove ownership. It is unclear where the vehicle comes from: it may have been imported in violation of the rules or even be listed as stolen. Until the authorities sort this out, you can forget about getting the vehicle back.

2. Over time your AODES ATV will need servicing and repairs, and no official AODES dealer will accept a “gray” ATV for repair. Such a vehicle is not eligible for warranty repair or recall campaigns. That is, any defect or factory flaw that dealers fix at the manufacturer’s expense, the owner of a “gray” ATV will have to fix at their own expense.

Problems with spare parts are also common. Vehicles sold by “gray” sellers are most often made for the domestic Chinese market. For this reason, some design elements of the utility vehicle may differ, and if something breaks, some parts will have to be sought blindly or without specific part numbers.

3. Some skilled gray-market sellers produce forged sports equipment passports for the vehicle or, worse, forge the PSM. In that case, if the serial numbers of the units do not match, and an official dealer discovers this, or when the vehicle is later resold, a report is sent to the authorities and a criminal case is opened under Article 327 of the Criminal Code of the Russian Federation (forgery, production or circulation of forged documents). The owner of the ATV may be recognized as either a victim or a suspect, depending on the circumstances and the skill of the lawyer. Such cases have already been recorded in different regions of Russia.

A vehicle carried on a trailer can also raise the suspicion of the traffic police. Control over illegally imported vehicles has tightened in the country, so even a traffic police inspector may ask for the ATV’s documents while it is being transported on a trailer.

4. Resale is impossible.

The lack of documents reduces the vehicle’s liquidity at market value almost to zero. Most buyers avoid such offers. The rest may insist on a 50–70% discount, since the risks are high.

Trading the vehicle in to a dealer will not work either. The dealer will not accept it without documents, because it cannot legally re-register it to a new owner.

As a result, the owner loses out: even if a sale does take place, the proceeds will not cover half of the vehicle’s original price.

5. Fraudsters are not asleep.

Fraudsters often pose as “gray” sellers. They show photos of the vehicle, promise to deliver it any moment now, and urge you to pay quickly before someone else snaps up the coveted model. But as soon as the prepayment reaches the account, the seller stops answering calls and messages.

All that comes to mind here is the folk saying: “The miser pays twice.”

The safest way to buy an AODES ATV is from official dealers.

Cash, non-cash, with VAT, in installments at 0%: there are plenty of options. And these options are definitely more advantageous if you look a little further ahead than today.
